That's because Shadowmere is a highly jealous horse and approves when you take out one of his (or her?) rivals.
Actually, you can get a bounty on your head if you kill and loot horses or sheep, so I guess it counts as a murder or assault.

My Imperial assassin character I mention of late got her blood ticket in by killing Maenlona after the "Sirens of Deception" quest. But not the 'real' Maenlona— the Guard version who pops into the farmhouse after the action. For a character at Level 3 or 4, taking on a chainmail-wearing Anvil City Guard was no picnic, but Cassie walked out of that house wearing a brand-new Anvil Guard's uniform on the path to her destiny.
It was a fitting beginning for the girl. She's
hardcore Dark Brotherhood. Sithis doesn't like beggars and barflies milling about in The Void, you know.

I went to Skingrad and started the quest Paranoia with Glarthir. I told him that all of them are spying on him so than he gave me the list of death to kill them. Instead of taking it to the guards I killed all of the people, get membership in the DB and earned more than 1000 septims.

Ahh, I remember my first murder well.
I was put about to do the quest for Corrick Northwode, that is to retrieve his dead wifes jade amulet from the goblins in a nearby mine. After going through all the trouble and hardship of doing a task that he surely could have done himself, not to mention my hatred of going into those vile goblin holes, when I returned to find him praying at his wifes grave I saw an opportunity to alleviate my disgust. I also wanted to keep the amulet for myself, but I also wanted the reward, so I gave it back, revieved my pay, got the blessing, then sneaked behind him as he prayed, drew back my sword and felled him in a single blow.
After looting his house, I got weary from carrying the loot west towards my fence, so I went to the Inn in Alleswell to rest, where Lucien paid me a visit in the night. Never looked back since then.

I'll probably kill Claudius Arcadia, and then take a nap in the cell across the way. It seems that Lucien considers the Imperial Prison secure enough for visits...

For the first time, I used the beggar by the garden at the waterfront. This was back when I only had Morrowind for the XBox [not the GOTY version that comes with the expansions, just the original game] and had never heard of the DB before. My dad let me know about it. The second time, It was Simplicia the Slow. I just wanted into the DB and she was conveniently there. From then on, she was my Dark Brotherhood blood ticket.

edit: I just saw Rhydderch Hael's post about how you shouldn't get into the Dark Brotherhood by just going and killing everyone. I just wanted you all to know that that isn't what I did. If you haven't noticed, my forum image is The Big Boss, so stealth is my breakfast, lunch, and dinner. What I did the first time was killed the random beggar in his sleep. BUT, after doing the DB stuff, I really gained a love for silently killing the innocent for pure pleasure. So from then on out, I would stalk Simplicia the Slow [I don't like her. I don't know why, I just don't] all day, hiding in the shadows, waiting for the perfect moment. That moment always seems to come when she goes to sleep in the alley on her pathetic little bedroll. The first time, I slowly creeped up to her, dagger in hand, and ended her misery. But now, I like to challenge myself with picking her off with my bow from as far away as I can. My best is about 45 ft. A shot right through the neck. Looked pretty painful.

The first time I got approached by Lucien Lachance was when I accidentally killed an Imperial Legion Soldier during the Battle for Kvatch quest. A heated fight against several Daedra can get confusing, and I may have inadvertantly killed the poor sod.
The second time I murdered someone, I had intended to join the DB, and to do this, I killed that stupid paranoidical bastard Glarthir

. You know, that Wood Elf who approaches you everytime you enter Skingrad, and asks you to spy on a few good citizens for him, and if you keep tellin' 'im they had nothing to do with anything, he'll try to kill you instead?
I only joined the DB a few times, though, since I'm a noble fighter and crusader at heart. I like ridding the world of all the bad guys more than I do murdering for the pleasure in commiting the act.

...And not just 'anybody', either. Bandits and marauders don't count. Odd, though— my new character has already tagged 25 'assaults' on her stat screen, though she has not been tagged for any offenses. I assume that any attack she initiated without warning (sneak attack) gets counted, though it never generates a bounty.
I did a reboot of Cassie-the-assassin, and she has yet to make her entry into the Brotherhood. She's kind of like a kid in a candy store, shopping for the perfect chocolate bunny — and when she finds it, she's gonna cave its little skull in.
Beggars? Why bother? Armor-clad Maelona? Been there. Umbra? Done that. Cassie is looking for something— creative. She's kinky like that.

Something I would like to try, if I ever start playing Oblivion again:
CODE
player.setav strength 5000
player setav marksman 5000
player.setav agility 5000
player.setav sneak 5000
Then do a run through the Market Sewers, and see if a sneak attack on a bandit counts.
My guess is that only NPCs with a certain responsibility level count.

I think that it's the aggressiveness. If the npc would attack you on sight, attacking him before he sees you will not get you a bounty, but will add to the assaults. At least, that's my theory.

My first character, a high elf, when the game was just out, I didn't know that there was a difficulty setting, low-leveled, and without a game guide, killed an Imperial Legion guy on horseback in the wilderness. I seem to recall accidentally killing the first Imperial Forester (or is it Imperial Legion Forester?) I came across. Not sure if I accidentally hit him, or if I thought he was a bandit. The next time I came across a couple of them, I had to help them defeat some bandits. Well, I could've just hung out of sight, but that would've resulted in BOTH of them dying, instead of only one.

My new character was trudging around the southwest wall of Bruma after paying her first shopping run to Ongar when she "jumped/was jumped by" a Timber Wolf. Low-level character vs T-wolf does tend to become a hairy little fight. Things looked bad until one of the aforementioned Foresters literally came to the fair damsel's rescue. So, a Forester will not become Cassie's next blood-ticket to the Brotherhood.

Actually yes it is, there a mod out there that's makes it possible, Althought some are still essentinal, I am guessing the perosn who created the mod forgot about those very few people (So I use the other mod to send them to etneral damantion), and now Cheydinal is nothing but a wasteland, only me and my DB's gag rule the town (And only Eilonwy got the good deal, I sent her to Anvil by another mod, Toastersays share mod), Some with Jeanne in Bruma.
Now for my stories, I think the first time I just created a killing machine and went killing everyone (I always have some files for good characters and some files for the bad).
But in my few latest ones, I just find the Luckess Lucy woman in Cheydinal and kill her.

Yes, ignore the mods for it, Pov's method is the more logical and practical way. Just be sure to only use it for games that you don't intend to play seriously. You might find an essential NPC has been killed in a brawl or eaten in the forest or something. It can happen.

I killed one of the Mythic Dawn "sleepers" before they start attacking you. I figured that I would have to kill one later on anyways, so I might as well get a murder out of it. It was the one in Chorrol, and I broke into his house and got him in his sleep. The guards never knew either and no one would miss him (since his house is in shambles, I doubt he would have gotten visitors if the AI was complex enough), so he was a good target. Good thing I made a made a char. to test the water, so to speak, before I created the two I care about.

My first time through the game, I killed Alval Uvani (or whatever) to gain entry into the Dark Brotherhood. I chose him because he never had any conversation topics and he was a huge prick. Always insulting people.

I have a seriously problem with murdering someone just to get into the DB. I still do it, but it always feels like a break in character for me.
I'm a thief and an assassin, not a homicidal psycopath. I hate killing just to kill. I eliminate targets, not innocent bystanders.
However, it seems there are quests which lead to murder, so maybe I'll do that next time.

If I recall, the last person I killed to get into the brotherhood was in the West Weald.
Remember Bear Season? Collecting bear fangs was hard because I slaughtered the bears previously, and didn't collect the fangs. Not to mention that I didn't read the quest text, and after a few bears, (Six) I didn't realize I was done. So I wandered around, slaying bears for two days.
When I finally go to check to see if I have enough fangs, the guy hands me a book. A BOOK. I slayed bears for a book? No! So I decided to be evil, murdered every one of his sheep, and when he came running at me, I beat him dead with a series of uppercuts. Then I looted his stuff and went on my merry way. A few hous later, Lucien provided me with my blade of woe.

I killed the steward of castle Bravil...the khajiit with the funny name. It was night-time, I was level 1, and I wanted in to the DBH. Sooo....I went running along the roads, and that poor gal was the first person I happened to meet. I sneak-attacked her, then to my horror she actually attacked e, and bloody nearly killed me (tough npc...) a few arrows later, and she was running for her life. Thankfully, she ran into Vindasel, where the daedra hanging arounf fireballed her ass. On very low health, she rushed out, and I put an arrow between her eyes.
I was a bit shocked when I found the keys to castle bravil on her corpse...and even more suprised when i got a 1k bounty on my head.

Actually, you'd need some sort of "remove quest stage" command, since there's no journal entry pertaining to the event until Lucie bites it.
Back on the subject, my new character already has compiled her own List of Death that puts Glarthir's to shame. It's only a question of who gets corpsed first:
1) The Dark Elf Primate of the Chapel of Arkay, for being such a jerk when Cassie asked about the sights and sounds of downtown Cheydinhal.
2) Chanel. Cassie shielded her from prosecution, and now it's time to ensure she'll never bring that fact to light.
3) Count of Bravil's son. Purely for the challenge. It's sort of like a fairy tale where the knight infiltrates the castle in order to rescue the princess. Only this time it's the princess doing the infiltration. And it ain't no rescue.
4) Jorundr. He gave Cassie a night she'll remember in that jail cell in Bruma. She's going back to remind him that, yes, she hasn't forgotten...
5) Velwyn Benirus. Sure, he sold her a house and helped in a fashion. But he's going to learn that greed has a price that is not measured in gold.
6) Erana. She knew about the book and knew the general area of Cloud Top, but couldn't be bothered to do any sort of hard work for herself?
7) Gogan and Maelona. Apparently Anvil's Finest cannot complete an investigation unless they lure an unsuspecting stranger to do all the dirty work for them at the risk of their own life.
