That's legal if you make it for yourself. But you wouldn't be asking if you knew how, would you? However, if you actually accomplish that and WON'T share with anyone, then most likely it's not a crime, though I am personally still unsure about it.

If you recreate the Fallout world in your own vision with your own materials from Oblivion, then it's not copyright infringement. If you copy/paste all the textures from Fallout 3 into Oblivion, then share it with others via some accessible source, then it is.

I understand, but in technical.. its possible? The Fallout gameplay sistem it possible "emulated" in Oblivion with adaptement, no only texture, but a quest ecc ecc or are a utopia?
I view mod Oblivion conversion (body, animation ecc) in fallout3nexus, and wondered if it was possible with construction set, or drag and drop with correction and added portalgates similar at Shivering...
It's a something like a new OblivionFallout or Falloblivion..

Everything is copyrighted - not just meshes and texures, but images they create as well, the game universe, certain characters (a quite difficult subject), names of whatever (with some exceptions, for example the word "Blade" cannot be protected) - anything truly recognizable. However it seems that copyright owners allow fans to recreate some of their property, as long as all the hard work they use in their games directly is not... expropriated. Maybe they view that as fanart, or sometimes cosplay.

fallout 3 also has many changes and updates to its game engine. while both fallout 3 and oblivion shares the same engine, there's enough difference between the two, that modding oblivion into fallout 3 is about as likely to succeed as modding morrowind into oblivion. i'm not saying that it cannot be done, i'm saying it is likely to be impossible.
